TICKET AND EVENT TERMS

These Terms of Sale (“Terms”) govern the purchase, possession, and use of tickets issued by MayFest LLC (“MayFest,” “we,” “us,” or “our”). By purchasing or using a ticket, attending the event, or entering any event grounds, you (“you” or “attendee”) agree to be bound by these Terms.
1. All Sales Final / No Refunds
All ticket sales are final. No refunds, exchanges, or cancellations are permitted for any reason, including but not limited to weather, illness, scheduling conflicts, dissatisfaction, or inability to attend.
2. Event is Rain or Shine
The event will occur rain or shine. You acknowledge and accept all risks associated with outdoor and weather-related conditions.
3. Rescheduling or Postponement
If the event is rescheduled, MayFest LLC will honor all valid, unused tickets for the new date.
If the event is canceled entirely, MayFest LLC may, at its sole discretion, issue a credit for a future event but is not obligated to provide refunds.
4. Non-Transferable, Non-Resellable Tickets
Tickets are non-transferable, non-resellable, and may only be used by the original purchaser unless expressly authorized in writing by MayFest LLC. Tickets found to be resold, transferred, duplicated, or tampered with may be voided without refund.
5. Right to Deny Entry / Remove Attendees
MayFest LLC reserves the right, at its sole discretion, to:
- Deny entry to any person for any reason
- Remove any attendee from the event for any reason
This includes but is not limited to disorderly conduct, safety concerns, policy violations, intoxication, harassment, or refusal to follow staff instructions. No refunds will be issued in such cases.
6. Assumption of Risk
By attending the event, you voluntarily assume all risks associated with attendance, including but not limited to:
- Injury (including serious injury or death)
- Property damage or theft
- Exposure to weather, wildlife, or natural hazards
- Participation in event activities
You agree that MayFest LLC is not liable for any such occurrences.
7. Prohibited Items
The following items are strictly prohibited:
- Weapons of any kind
- Fireworks or explosives
- Strobe lights, lasers, laser pens, or disruptive lighting
- Irritants (pepper spray, mace, etc.)
- Illegal substances
- Drones or UAVs
- Professional cameras or recording equipment (unless approved)
- Any item deemed dangerous or disruptive by event staff
Possession of prohibited items may result in denial of entry or removal from the event without refund.
8. BYOB Policy (Allowed)
Attendees may bring their own alcohol (“BYOB”) in accordance with event policies and Michigan law.
Attendees are solely responsible for their alcohol consumption and behavior.
MayFest LLC reserves the right to confiscate dangerous quantities or deny entry to visibly intoxicated persons.
9. Changes to Lineup or Schedule
All performer lineups, schedules, times, activities, and event features are subject to change without notice. No refunds will be issued as a result of lineup or schedule changes.
10. Personal Belongings & Lost Items
You are responsible for your personal property. MayFest LLC is not responsible for:
- Lost, stolen, or damaged items
- Property left unattended
- Items turned in but not claimed
11. Media Release
By attending the event, you grant MayFest LLC permission to capture and use your likeness, image, voice, and appearance in photographs, video, and livestreams for promotional or commercial purposes without compensation.
12. Michigan Law Applies
These Terms and all related disputes shall be governed exclusively by the laws of the State of Michigan, without regard to conflict-of-law principles.
13. Mediation Clause
Before either party may file a lawsuit concerning any dispute, claim, or controversy arising from or relating to your ticket purchase, event attendance, these Terms, or any acts or omissions of MayFest LLC (“Claims”), the parties must first engage in good-faith mediation.
Mediation shall be conducted in Michigan, using a mutually agreed-upon neutral mediator, or, if the parties cannot agree, one appointed by the American Arbitration Association (AAA) under its Mediation Rules.
- Each party pays its own costs.
- Mediator fees are shared equally unless otherwise agreed.
- Mediation is a condition precedent to litigation.
MayFest LLC may seek immediate injunctive or equitable relief in a Michigan court to protect its rights or event security.
14. No Class Actions
All Claims must be brought individually and not as part of any class, collective, consolidated, or representative action. You waive the right to participate in any class or group lawsuit.
15. Limitation of Liability
To the maximum extent permitted by law, MayFest LLC and its owners, officers, staff, contractors, vendors, and affiliates are not liable for:
- Personal injury
- Property damage
- Lost or stolen items
- Incidents caused by other attendees
- Acts of nature or unforeseeable events
- Any indirect, incidental, or consequential damages
Your sole remedy, if any, is limited to the original ticket purchase price.
16. Agreement to Terms
By purchasing or using a ticket, entering the event grounds, or attending any MayFest LLC activity, you affirm that you have read, understand, and agree to be bound by these Terms of Sale.
